Shopify provides the e-commerce platform that enables MICSS to offer products and services online. Your purchase agreement is concluded with J. Werkmeester trading as MICSS, not with Shopify.

2. Application of These Terms

These Terms of Service apply to your use of the MICSS website and to purchases made through the online store.

By placing an order, you agree to these Terms of Service and to the policies made available during checkout, including the Privacy Policy and Refund Policy.

Nothing in these Terms limits any mandatory consumer rights that apply to you under Dutch law or the law of the country in which you normally reside.

3. Eligibility and Customer Information

You must be at least 18 years old or have permission from a parent or legal guardian to place an order.

You are responsible for providing complete and accurate contact, billing and payment information. In particular, you must provide a valid email address so that we can send your order confirmation and digital download link.

4. Digital Products

MICSS currently offers digital content, including the product Lifestyle for a Lifetime – The MICSS E-book.

The e-book:

  • Is supplied as a downloadable PDF file.
  • Is written in English.
  • Is a digital product; no physical book will be shipped.
  • Requires a compatible device and PDF reader.
  • Requires an internet connection to complete the purchase and download the file.

The product description, price and essential characteristics are displayed on the product page before you place your order.

5. Orders and Formation of the Agreement

Placing an order constitutes an offer to purchase the selected product. The purchase agreement is formed when payment has been accepted and we send an order confirmation.

We may refuse or cancel an order where reasonably necessary, for example in the event of suspected fraud, an unauthorised transaction, a technical error or an obvious pricing error. If payment has already been collected for a cancelled order, the amount paid will be refunded.

6. Prices, VAT and Payment

Prices are displayed in the currency shown in the store. The total price, including applicable VAT and any other charges, is shown before you complete your order.

Payments are processed through Shopify and the payment provider selected during checkout. MICSS does not directly store complete payment-card details.

You are responsible for ensuring that you are authorised to use the selected payment method.

7. Digital Delivery

After successful payment, the e-book is made available through:

  • The download section on the order confirmation or order status page; and
  • A download link sent to the email address provided during checkout.

The download link can be used up to five times. This limit is intended to allow you to save the file to your personal devices. It does not permit five different people to use or receive the e-book.

You should save a copy of the PDF to your device after downloading it.

If a legitimate technical problem uses up your download attempts or prevents access to the file, contact info@jwerkmeester.nl and include your order number. We will investigate the issue and, where appropriate, restore access or provide a replacement download.

8. Right of Withdrawal for Digital Content

Consumers in the European Union and European Economic Area normally have a statutory fourteen-day right of withdrawal for distance purchases.

For digital content that is not supplied on a physical medium, this right may end once delivery begins, but only where, before delivery:

  1. You expressly consent to immediate delivery during the withdrawal period; and
  2. You acknowledge that you lose your right of withdrawal once the download begins.

Where this consent and acknowledgement are requested during checkout, the digital download will be made available after the required consent has been provided. Confirmation will be provided with the order or digital-delivery communication.

If the legal requirements for losing the right of withdrawal have not been met, your statutory withdrawal rights remain unaffected.

The loss of the withdrawal right does not affect your legal remedies if the digital content is faulty, inaccessible or materially different from its description.

9. Problems, Refunds and Legal Remedies

Our separate Refund Policy explains how requests are handled.

Please contact us if:

  • You were charged more than once for the same order.
  • You cannot access the purchased file.
  • The supplied PDF is corrupt or incomplete.
  • You received the wrong product.
  • The digital product is materially different from its description.

Where appropriate, we may first restore download access, repair the problem or supply a replacement file. A refund, price reduction or other remedy will be provided where required by applicable consumer law.

10. Personal Licence

After completing your purchase, you receive a personal, limited, non-exclusive and non-transferable licence to download, store and use the e-book for your own private, non-commercial purposes.

Unless MICSS gives prior written permission, you may not:

  • Share the PDF or download link with another person.
  • Upload the e-book to a public or private sharing platform.
  • Sell, rent, sublicense or otherwise distribute the e-book.
  • Reproduce substantial parts of the e-book.
  • Use the e-book as material for a commercial course, coaching programme or membership.
  • Modify the content and present it as your own.
  • Remove copyright, trademark or ownership notices.
  • Use the content to train an artificial-intelligence system or include it in a commercial dataset.
  • Circumvent download restrictions or access-control measures.

Nothing in this section restricts uses expressly permitted by mandatory law, such as lawful quotation.

11. Intellectual Property

The website, e-book, written content, graphics, photographs, illustrations, branding and other original materials made available by MICSS are protected by intellectual-property laws.

Purchasing the e-book does not transfer any copyright, trademark or other ownership right to you. All rights not expressly granted under these Terms remain with MICSS or the relevant rights holder.

12. Health and Educational Disclaimer

MICSS content is provided for general educational and informational purposes. It is not medical advice, diagnosis, treatment, physiotherapy or a substitute for professional healthcare.

You are responsible for deciding whether exercises, lifestyle suggestions or other information are suitable for your circumstances. Consult a qualified healthcare professional before making significant changes, particularly if you have an injury, medical condition, symptoms, are pregnant or have concerns about your health.

Stop an activity and seek appropriate professional advice if you experience pain, dizziness, breathing difficulties or other concerning symptoms.

Individual outcomes differ. MICSS does not guarantee a particular physical, health, performance or lifestyle result.

This disclaimer does not exclude responsibility or legal remedies that cannot lawfully be excluded.

13. Accounts and Security

If you create a customer account, you are responsible for protecting your login details and for activity performed through your account.

Contact us promptly if you believe your account or download link has been accessed without authorisation.

14. Acceptable Use of the Website

You may not use the website:

  • For unlawful or fraudulent purposes.
  • To transmit malicious code or interfere with website security.
  • To obtain unauthorised access to systems or customer information.
  • To scrape, reproduce or commercially exploit website content without permission.
  • To infringe the intellectual-property, privacy or other rights of MICSS or another person.

15. Third-Party Services and Links

The store may use or link to services provided by Shopify, payment providers and other third parties. These services may be governed by their own terms and privacy policies.

MICSS is not responsible for the independent content or practices of third-party websites. This does not affect MICSS’s responsibility for properly performing its agreement with you where that responsibility applies by law.

16. Availability and Updates

We take reasonable steps to keep the website and digital-delivery systems available, but temporary interruptions may occur because of maintenance, security issues or circumstances outside our reasonable control.

We may improve or update the e-book from time to time. Unless expressly stated otherwise, purchasing the current version does not create an obligation for MICSS to provide future editions or additional content.

Changes to these Terms apply prospectively and do not remove rights already acquired under a completed purchase.

17. Liability

MICSS remains responsible where required by applicable law.

Nothing in these Terms excludes or limits liability for:

  • Intentional misconduct or gross negligence.
  • Death or personal injury where liability cannot lawfully be excluded.
  • Fraud or fraudulent misrepresentation.
  • Mandatory consumer guarantees or statutory remedies.
  • Any other liability that cannot legally be excluded or limited.

To the extent permitted by law, MICSS is not responsible for problems caused solely by an incompatible device, missing PDF software, the customer’s internet connection, unauthorised sharing or use of the product contrary to these Terms.

18. Privacy

We process personal information in accordance with our Privacy Policy. Please review that policy for information about the data we collect, why we use it, how long it may be retained and the rights available to you.

19. Suspension or Termination

We may suspend access to the website, an account or a download link where there is reasonable evidence of fraud, unauthorised distribution, abuse of the service or a material breach of these Terms.

Where appropriate, we will consider the nature and seriousness of the breach before taking action. Suspension or termination does not affect mandatory consumer rights relating to a lawful purchase.

Please include your order number and a clear description of the issue. We aim to respond within three business days and will work with you toward an appropriate solution in accordance with applicable consumer law.

21. Governing Law and Jurisdiction

These Terms and agreements with MICSS are governed by Dutch law.

If you are a consumer residing outside the Netherlands, this choice of law does not deprive you of mandatory consumer protection provided by the law of your country of residence.

Disputes may be submitted to a court that has jurisdiction under applicable consumer and procedural law.

22. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply. The affected provision will be interpreted or replaced to the minimum extent necessary to make it lawful and enforceable.
